What are my rights regarding a Medical Records Fee? And why can Doctor's charge me a fee for MY information?

I want to know if there are any laws protecting my rights to obtain MY medical records. Is there any Federal laws regulating this? Also, does New Jersey have any laws regulating this?


Can I go to the Dr's office, obtain my folder and photocopy them? It would be cheaper than the $15 fee I get charged!


I believe charging me money for what is rightfully mine is unfair. Please help.


Only enlightening and explanatory answers please.|||You have the right to YOUR medical records, the so-called law allows them to charge a nominal fee not to exceed the cost of retrieving the info, they are not allowed to profit from it! Meaning that if office assistant(and they must use the lowest paid person) makes $10 an hour and they take 15 miniutes to collect and return your records to their file legally they can only charge you $2.50 plus the cost of their copies(ink and paper) 5 cents per page is about right.





Clearly $15 is an exhorbinate amount unless your med records are thick as a NYC phone book. If not they are likely using the exceesive fee to deter you from obtaining them which is illegal.





If they will allow you to view them for free, do it but they won't let you leave with them, the papers are theirs, only the info belongs to you. If you can bring a portable copier/digital camera ok.|||My source was federally based and partially incorrect. Medical records are governed by the states. |||Although you own the 'information' the hospital has to keep the actual records.





So you have unlimited access to the records, but the hospital has to maintain them.





The fee is for copying. $15 is not that much. At 10 cents a page that is 150 pages|||Federal law specifically allows doctors and hospitals to charge reasonable fees for copying.|||The information is yours, the paper and cost to copy is theirs.





You have a right to pay it. No you can not go into thier office and use thier equipment to copy it.





15 sounds very cheap for this compared to most charges, I would be smiling to just pay 15 dollars for medical records|||YOu have to understand that the information contained within the record is yours, however the record is the physicians official business record of your care. The fee for copying is not meant for the physician to make a profit however it is meant for the physician to re-coup some of the costs associated with copying ie staff time, copier toner and paper. The $15.00 is a nominal amount and you should just pay for it. Under the HIPAA regulations you do have a right to inspect and copy the record, and the physician has the right to charge a small fee for doing so.|||he charges all that ask for your information around 拢50.00 but it actually cost nothing to sit and look at it should they allow you to. |||Gladly pay the $15 for your records. Some states won't even give you the chance to see your records!|||You have whatever rights the Doctors office made you initially sign in the beginnig when you went their the very 1st time!!! Also, you have the right as the individual or patient who should always receive a medical record when you request it, period!!!
